Overtime must be paid if an employee works more than 40 hours/week IF the employee is paid by the hour. Although the 40-hour workweek averages out to 8 hours per day, overtime in New Mexico is calculated weekly and will be reflected on the employee’s paycheck for that pay period.
The employee is not entitled to overtime unless he works over 40 hours in a workweek, even if he works 12 consecutive hours in one day. Unless an emergency arises, an employer cannot require an employee to work more than 16 hours per day in New Mexico.
According to New Mexico Child Labor Laws, children 14 and 15 years of age can work during the following hours: non-school hours, 3 hours on a school day, and 8 hours on a non-school day. They can only work from 7 a.m. to 7 p.m., except from June 1 through Labor Day, when the hours change to 9 p.m. A minor 16 years old or older has no time restrictions.
