Texas Top Court Declined The Final Abortion Law Challenge
The Texas Supreme Court voted against abortion providers’ challenge to the state abortion ban.
The Senate Bill 8, or Texas Heartbeat Act, prohibits all abortions after six weeks. Also, the document includes a provision that enables citizens to take action against any person who helps pregnant women proceed with an abortion by any means.
Texas abortion providers considered the Heartbeat Act unconstitutional and demanded some state officials not enforce the law.
According to the lawsuit filed by the Texas Supreme Court in response, the law “does not authorize the state-agency executives to enforce the state-agency executives to enforce the Act’s requirements, either directly or indirectly.” The Texas district court and US Supreme Court did not influence the case and delegated it to the Texas Supreme Court.
The final jury’s decision caused negative feedback among local non-profit organizations. For instance, the American Civil Liberties Union (ACLU) called the ruling “a devastating blow for abortion rights in Texas and across the country.”
